All SSPX Marriages Are Now "DE FACTO" Valid

Definition of DE FACTO:


1: actual; especially : being such in effect though not formally recognized <a de facto state of war>

2: exercising power as if legally constituted <a de facto government>



For those who ascribe to "all SSPX-marriages-are-invalid" meme, please note: the Archdiocese of Chicago has - albeit unintentionally - banished this notion. Why and how? With their apparent disregard of Canon 844 during the recent funeral Mass for Cardinal George, the Archdiocese has shown that another of the numerous Canon Laws that help govern the Roman Catholic Church can be publicly ignored by those charged with their application in defending the Faith and the Truths contained therein. 

Therefore, in order to correct another injustice and to promote the Year of Mercy, Canon 1108 can now be added to the ever-lengthening list of Canon Laws that are OK to ignore. This particular Canon, as another of the many useless and non-enforced-because-of-political-correctness Canon Laws (are they really "laws" anyway, or just "guidelines"??) can now, "de facto" (how I like this word!), be wiped from the law books because of its obvious lack of necessity. Yes...Canon 1108 can now join the dust-bin of those pesky Canons deemed non-PC correct (I can assume no other reason for their non-enforcement) and which can - nay MUST -
be ignored by local bishops, without fear of reprisal or recrimination from higher authority.

So, henceforth, all SSPX marriages can now be considered, "de facto", valid!! 

After all, if the SSPX can be said to still be in "de facto" schism (which they are not), "de facto" out of communion (really? and the LCWR is not??), then why cannot their marriages be "de facto" valid? All the bishops have to do is to "de facto" not apply Canon 1108, just like they don't apply other Canons, to remain in correct-PCness with the world. See how easy it is? 

Wait! Perhaps the term "De Facto" should somehow be incorporated into Canon Law?!? No..that wouldn't work. It would just become another law that is arbitrarily ignored and would eventually fall into disuse via the "de facto" application. Ugh! Confusing, no? Better leave well enough alone, then.

Consider the current list-of-laws-to-be-ignored, as of this week anyway:

Canons 844, 915, 916; Canons 1152, 1153.2 1155, 1146.2, 1676, 1695, 1713 (These are the Canons that mandate seeking the reconciliation of separated spouses.) 

To this list we can now safely add Canon 1108! 


What does all this mean for Catholic spouses?  Simply this: that any petitioner-spouse whose marital vows were pronounced before an SSPX priest and who now desires to petition the local diocesan tribunal for an annulment, can no longer use that particular Canon for their personal "get out of jail free" card. Oh no! Now they will find that Canon 1108 no longer has the effect of law, as it is effectively being ignored by any and all local Bishops, Marriage Tribunals, Judicial Vicars, et al., just like numerous other Canons in the 1983 Code of Canon Law. (Sadly, my 20-plus year marriage was destroyed and my family decimated by this very Canon, too late to fall under this new Year of Mercy guideline.)


However, before being able to fully explore their newly-found mid-marital life individuality-and-autonomy crisis obtained via civil divorce, this also means that the petitioner-spouse must now go the "full-monty": prepare to meet the Tribunal members, state their case, find witnesses to back up their statements, find an advocate, read up on the Tribunal Laws, etc, etc. To be sure, this could take years - at least two or three and possibly more, is my understanding. 

But wait! There may yet be a silver lining in this dark cloud of a marriage-in-trouble... for maybe, just maybe, in the intervening years, it will give said petitioner-spouse the needed brake to reflect before they commit to a course of action they haven't a clue as to the devastation it will leave in its wake. If not - if they do not use the time for much-needed reflection - they will fast discover the true meaning of the term "broken-family" in all its glory, should they refuse the Grace this respite may offer. [I suggest, assuming you get this far, that you take the Grace offered...you do not want to go where you're headed, believe me...]

Some may think this post to be nonsensical and just plain stupid. Well, so is the non-enforcement of Canon Laws for the sake of being politically correct and of applying one particular law in its strictest sense, while totally ignoring an entire group of other laws altogether. This is Catholic Charity? This is Just? This is Merciful!!??!! This is Pro-Family??!!! This is Pro-Marriage???!!!???

There is, by all appearances, no rhyme or reason to applying laws any longer - here we do; there we don't. This group holds fast to Tradition so we apply them with full force; that group is fully modern so we'll look the other way despite their public heresies. The Catholic Church is being laughed at and those in charge don't seem to care or are oblivious to it, which means they are either increasingly naive or patently stupid.

The failure to make use of current Canon Laws to preserve first marriages or ignore those that can lead Catholics who publicly support abortion and / or contraception back into the bosom of Holy Mother Church is tantamount to dereliction of duty, in my opinion. As is the failure to quickly address the Canonical situation with the SSPX, seek an equitable and just solution that allows this Priestly Fraternity to continue their apostolate, and which will finally remove the non-existent "schism" meme that still pervades the thought processes of many post-conciliar Catholics - whether priest or lay. It is time to remove the impediments, real or imagined, that are still chained to the SSPX and to which every Catholic - indeed, every Roman Catholic - should be praying for Rome to quickly unbind. 

The SSPX is not the enemy of Rome, nor of the Catholic Faith, nor of Catholic Marriage. It is one of their most staunchest defenders and loyal ally's.

However, if this abuse of children happens in India, then it most likely happens anywhere the ceremony takes place, including in the USA. [Edit.]


Where is the outcry! Where are the mass demonstrations? Where is the line of politicians on C-Span venting their anger at this molestation and abuse of children! Where is the call for the DOJ and Eric Holder Loretta Lynch to investigate this outright and malicious form of child abuse! Where is Rev. Al Sharpton and the MSNBC News cam-crew interviewing and filming the religious leader behind this! Where is the letter-writing campaign to the US Chief of Islam by liberal editors and academia seeking to oust this religious leader and have him replaced with a more sensitive-to-the-needs-of-children leader? Where is Susan Sarandon and the Hollywood elite being interviewed, misty-eyed, on TV over this most egregious form of religious child-abuse in the US?

Oh! Wait! Not only are these children Muslim (which makes it OK, I guess, and not a violation of US child abuse laws), but they are OUTSIDE the womb and therefore (I suppose??) this "religious" ceremony must be a legal and protected form of child abuse. Exactly like the abortion laws in the United States that allow children in the womb to be mutilated, torn apart, and sucked out of the sanctity of the Mother's womb:





What, may I ask, is the difference? !?! 

How can one "religious" group (Islam) not be chastised and excoriated over an apparently "religious" teaching and practice (Ashura), while another religious group (Roman Catholics) are chastised and excoriated over theirs (Anti-Abortion/Contraception)? 

The Land of the Free and The Home of the Brave?? 

More like the-Land-of-partial-tolerance-for-some and the-home-of-the-spineless.

Our Lady of America

Due to the necessary attention required of some personal and family matters, I will be posting somewhat sporadically from now through summer. But I wish to leave you with a link to a particular devotion to Our Lady, courtesy of the Restore DC Catholicism blog (and a good blog to routinely read, by the way.)

Our Lady of America was previously unknown to me, but not so to Raymond Cardinal Burke, who wrote this letter to the USCCB in 2007 when he was still Archbishop of St. Louis, MO (my old hometown and where I worked just a few blocks from The Cathedral Basilica St. Louis.) He provides some interesting history of the devotion and of the apparition to Sister Mary Ephrem, which is also available on the website here.

The devotion is of particular interest, primarily because of the reverse side of its associated medal, which bears the image of Our Lady of America on the front and on the rear the image of the Coat of Arms of the Christian family. 

 

In light of the upcoming Family Synod in October, it is hard to dismiss its necessity!

Oh Immaculate Mother, Queen of our country, open our hearts, our homes, and our land to the coming of Jesus, your Divine Son. Argentina formally recognizes SSPX as part of the Catholic Church - at the request of the Archbishop of Buenos Aires (and Pope Francis?)

Our partners at Adelante de la Fe have broken the news that the Argentinian government has recognized the SSPX as part of the Roman Catholic Church: La FSSPX reconocida en Argentina como parte de la Iglesia Católica Romana.In the words of the official state Resolution granting this recognition:

HAVING SEEN the Procedure N. 9028/2015 of the Registry of the MINISTRY OF FOREIGN RELATIONS AND WORSHIP, Law 24483, and its Regulation Decree N. 491, of September 21, 1995, and



CONSIDERING:



That according to Protocol N. 084/15, of February 23, 2015, the Archbishop of Buenos Aires, Mario Aurelio Cardinal POLI, requests that the "FRATERNITY OF THE APOSTLES OF JESUS AND MARY" (PRIESTLY FRATERNITY OF SAINT PIUS X) be held, up to the moment in which it finds its definitive juridical framing within the Church Universal, as an Association of Diocesan Right, according to what is established by canon 298 of the Code of Canon Law, being in fieri [henceforth and in the meantime] a Society of Apostolic Life, with all the benefits that correspond to it, and complying with all obligations to which the same refers, also accepting all responsibilities that belong to the diocesan Prelate.[added emphasis]


That to the aforesaid fraternity be accredited its character as a public juridical person within the ROMAN CATHOLIC APOSTOLIC CHURCH, according to the norms of the Code of Canon Law.[added emphasis]

That according to its statutes, approved by competent ecclesiastical authority, the fraternity is a priestly society of common life without vows, as with the societies of Foreign Missions (cf. Chapter I, Article 1, Statutes of the Fraternity of the Apostles of Jesus and Mary).

That Article 3, letter f, of the Decree N. 491.95 authorizes the inscription in the Registry created by Law N. 24483 of the juridical persons recognized by ecclesiastical authority that ressemble or are analogous to the institutes of consecrated life and societies of apostolic life.

That the requesting organization has fulfilled all requirements demanded by the regulations in force, including its statutes, the decree of erection, and a statement, according to what is established in Law N. 24483.

That it is fitting that the present inscription take place, considering that petitioner fits within the terms predicted in Article 3, letter f, of the Decree N. 491/95.

For these reasons.

THE SECRETARY OF WORSHIP

decrees:

ARTICLE 1 - The juridical person of the "FRATERNITY OF THE APOSTLES OF JESUS AND MARY" (PRIESTLY FRATERNITY OF SAINT PIUS X), Association of Diocesan Right, with legal and special residence at 1318 Calle Venezuela, AUTONOMOUS CITY OF BUENOS AIRES, is incribed under the number THREE HUNDRED AND EIGHTY ONE (381) of the Registry of Institutes of Consecrated Life.

ARTICLE 2 - It is granted to the aforesaid organization the character of an entity of public welfare, with all the effects that correspond to it.

ARTICLE 3 - Let it be known that the aforesaid juridical person benefits from the treatment afforded by Article 20, letter e, of the Income Tax Law (text ordered in 1997).

ARTICLE 4 - Let it be made known, let it be published, let it be given to the National Administration of the Official Registry, and let it be archived.

The Resolution came from the Secretary of Worship (Secretaría de Culto)the office of the Argentine Ministry of Foreign Relations and Worship (Ministerio de Relaciones Exteriores y Culto) that deals with religious bodies, in particular with the Catholic Church, which remains the supported State religion in the Argentine Republic (Article 2 of the 1853 Constitution, revised in 1994). The Resolution credits Cardinal Poli, handpicked by Pope Francis as his own successor in Buenos Aires, with initiating the request for the SSPX to be recognized, but there is every reason to believe that the request came from much higher, from the very top. Rorate reported in May last year that Pope Francis himself had promised to help the SSPX gain recognition in his home country as a Catholic association for legal and administrative purposes:
"When, as a Cardinal, he was in South America, the District Superior [Fr. Christian Bouchacourt] came to ask him for an administrative favor with no relation to the Church; a visa problem, of permanent residency. The Argentine government, which is very leftwing, makes use of the concordat that was established to protect the Church to bother us quite seriously, and tells us, "you say you are Catholic, it is thus necessary for you to have the signature of the bishop in order to reside in the country." The District Superior therefore went to him to present the problem: there was an easy solution, and that would be to declare ourselves an independent church [before Civil Law], but we did not want to do it because we are Catholic. And the Cardinal told us, "no, no, you are Catholic, that is evident; I will help you;" he wrote a letter in our favor to the government, that is so leftwing that they managed to find an opposing letter by the nuncio. Therefore, a 0-0 tie. Now he is the pope, and our lawyer had the opportunity of having a meeting with the Pope. He told him that the problem was still going on with the Society, and asked him to please designate a bishop in Argentina with whom we could sort out this problem. The Pope told him, "Yes, and this bishop is myself, I promised to help, and I will do it."

Does this signal an imminent doctrinal and canonical rapprochement between Rome and the SSPX? It would not seem so, from Fellay's qualification that this favor was solicited to ease the visa and residency problems of SSPX members assigned to Argentina. The SSPX could easily have obtained, as almost every other faith, state recognition in Argentina if it had requested recognition as a separate body, for merely civil law purposes -- what is more important is that this demonstrates both the SSPX's resolve not to be an independent Church, not to be seen as outside the Catholic Church; and Rome's recognition that the SSPX is essentially Catholic.

REPOST/UPDATE: Ann Barnhart's Defense of Marriage

It just feels like the right time to re-post this from from last January, if for no other reason than it might find its way to a bishop or two...who might then re-think their currently favorable position for Communion for the divorced and re-married...who might then forward it to Cardinal friends in Rome, who will also re-think their own currently favorable position on communion for the divorced and remarried...who then will pass a copy along to a certain white cassock wearing Bishop, who will understand its import - finally - and put a kee-bosh on any October surprises. <sigh>[Ed.]


Ann Barnhardt has done a fine job of defending marriage and dissing divorce / annulments as part of a recent post of praying for those you haven't met yet...including a future spouse. Her final comment is particularly succinct.

"3. I received quite a lot of feedback regarding prayer for those we have not yet met, and was reminded that praying for one’s future spouse beginning in childhood was a widespread practice in the Church before the Marxist-sodomiticalists infiltrated and began their unrelenting campaign of destruction in the mid-1960s. Maybe if people learned again to pray for their spouse before they met them, they would realize that their future spouse is a precious human being, and their future marriage a sacrament. Instead, we have clergy today saying that with regards to marriage, “everyone deserves a second chance”. Thankfully Our Blessed Lord does not agree.

Our Lord entered into a covenant marriage.
The relationship … went south through no fault of His.



This is what a Covenant Marriage in which one spouse turns out to be less-than-perfect looks like. Oddly, no annulment has ever been sought in this case.

Instead of annulling the covenant, seeking a divorce, abandoning the relationship, or killing the spouse (which was and is His right as the Divine Judge – just ask Noah), He instead persevered unto torture and death at the hands of His beloved spouse, and then doubled-down on the marriage, instituting the Holy Sacrifice of the Mass and the Eucharist so that He could renew the Marriage Sacrament and the Divine Embrace EVERY. SINGLE. DAY. FOREVER.

Just remember, if everyone deserves a “second chance” with regards to marriage, then Our Blessed Lord goes to the front of that line, the Gates of Heaven slam shut, and we all go to hell exactly as we deserve."

                     INSTRUCTION ON EASTER




GOSPEL (Mark XVI. 1-7.): At that time, Mary Magdalen, and Mary the mother of James and Salome, bought sweet spices, that, coming, they, might anoint Jesus. And very early in the morning, the first, day, of the week, they come to the sepulchre, the sun being now risen. And they said one to another: Who shall roll us back the stone from the door of the sepulchre? And looking, they saw the stone rolled back, for it was very great. And, entering into the sepulchre they saw a young man sitting on the right side, clothed with a white robe, and they were astonished. Who saith to them: Be not affrighted; you seek Jesus of Nazareth; who was crucified: he is risen, he is not here; behold the place where they laid him. But go, tell his disciples, and Peter, that he goeth before you into Galilee: there you shall see him, as he told you.


ASPIRATION: I rejoice, O my Jesus, that Thou hast victoriously risen from death. By Thy triumph over death, hell and the devil, grant us the grace to subdue our evil inclinations, walk in a new life, and die to all earthly things. Amen.

INSTRUCTION: It is certainly true that Christ, by His death on the cross and by His resurrection, has rendered perfect satisfaction; and effected man's redemption; (Heb. IX. 12.) but we must not imagine that there is no further need of doing penance, or of working out our salvation. For, as the children of Israel, though freed from Pharao's bondage, had to fight long and against many enemies in order to gain the Promised Land, so also must we, though freed by Christ from the servitude .of the devil, battle against our enemies to the end of our lives to obtain the promised, heavenly land, for no one is crowned unless he has properly fought. (II Tim. II. 5.) We must apply the merits of the redemption and satisfaction of Christ to our soul by the frequent reception of the holy sacraments; by imitating His virtues; by patiently bearing our trials and sufferings, and by a penitential life.
